1. Agreement to terms
By accessing or using ViralDesk, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform.
2. Description of service
ViralDesk is a software-as-a-service (SaaS) platform providing CRM, lead capture, booking, automation and messaging tools for small businesses. The platform is provided on a subscription basis.
3. Your account
You are responsible for maintaining the security of your account and all activity that occurs under your account. You must not share access credentials or allow unauthorised users to access your account.
4. Acceptable use
You agree to use ViralDesk only for lawful purposes and in accordance with applicable regulations. You must not use the platform to send unsolicited messages, engage in deceptive practices, or process personal data without a lawful basis.
5. Subscription and billing
ViralDesk is available on monthly and annual billing cycles. Annual plans are billed upfront. Prices are subject to change with reasonable notice. Your subscription renews automatically unless you cancel before the renewal date.
6. Cancellation
You may cancel your subscription renewal at any time. Access continues until the end of your current paid period. We do not offer refunds for unused portions of a subscription period except where required by law.
7. Data and privacy
Your use of the platform is also governed by our Privacy Policy. You are responsible for ensuring any customer data you process through ViralDesk is handled in compliance with applicable data protection laws, including UK GDPR.
8. Limitation of liability
To the extent permitted by law, ViralDesk and Social Spark shall not be liable for indirect, incidental or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid in the preceding 12 months.
9. Changes to these terms
We may update these terms from time to time. Where changes are material, we will notify you with at least 30 days' notice. Continued use of the platform after changes take effect constitutes acceptance.
10. Governing law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
